Disclosure required by Article 13 of Legislative Decree 196 of 30 June 2003

(Data Protection Code)

This disclosure is provided in accordance with Article 13 of Italian Legislative Decree no. 196 of 30 April 2003, i.e. Italy’s Data Protection Code, for all those who interact with the web services of this site, which are accessible from the address www.beonmelab.com, hereinafter referred to simply as “User(s)”.

The disclosure is inspired by Recommendation no. 2/2001, which European data protection authorities, united as per Article 29 of Directive no. 95/46/EC, adopted on 17 May 2001 in order to establish certain minimum requirements for the collection of personal information online and, in particular, for the procedures, timing, and nature of information that data controllers must provide to Users when visiting web pages, regardless of the purpose of such visits.

VOLUNTARY NATURE OF THE PROVISION OF INFORMATION

Users are free to provide or not their own personal information as requested via the forms for site registration, for the online purchase of BeOnMe goods (hereinafter simply “Goods”) and/or for requests to send informational materials and other communications. Failure to provide such information may prohibit execution of the related request.

PURPOSES OF DATA HANDLING

Data handling shall concern the transactions or set of transactions (e.g. collection, registration, organization, storage, processing, communication, modification, selection, use, deletion, destruction) regarding the personal information provided when filling out the aforementioned registration forms and submitting online orders for the purchase of Goods.

In particular, this data handling is done in order to:
1. fulfill any legal and/or regulatory obligations (e.g. fiscal and financial reporting obligations);
2. manage and perform contracts regularly executed between BeOnMe and the User;
3. fulfill obligations arising from and connected to said contract, such as: the provision of Goods; payments; execution of shipping and post-sale services.

With regard to the purposes of points 1, 2 and 3 above, the provision of information is necessary in order to complete the online purchase of Goods, and the User’s refusal to provide it will make it impossible for BeOnMe to execute the request.

For proper execution of these activities, primarily the personnel of BeOnMe’s IT division and post-sale service unit will have access to the information. Only that data which is necessary in order to execute the activities assigned may be made available to BeOnMe providers of services connected and functional to the aforementioned purposes, including: companies that provide information-technology services, including hosting services; companies that provide commercial services to BeOnMe, such as data entry, transport, payment, and shipping. These parties operate specifically as data processors in respect of BeOnMe. A list of these third parties is available at the offices of the Data Controller. User data will not be disclosed to or shared with third parties for any other reason.

METHODS OF DATA HANDLING

Personal information is mainly processed digitally. This data is kept strictly for the period of time necessary for execution of the activities specified under points 1, 2 and 3 above. Specific security measures are implemented in order to prevent the loss, illegal or improper use, and unauthorized access.

RIGHTS OF THE DATA SUBJECT

Parties to which the personal information refers, as defined under Article 7 of the aforementioned Data Protection Code, have the right, at any time, to obtain confirmation of the existence of such information, to know its content and origin, to verify its accuracy, and to request additions, updates, or corrections. In accordance with said Article, these parties also have the right to request that the data be deleted or made anonymous, to demand the cessation of any illicit handling and, in any event, to oppose the processing of personal data for just cause. In order to exercise these rights, it is necessary to contact BeOnMe, to the attention of the data controller and processor, in writing using the e-mail addresses specified above.

LOCATION OF DATA PROCESSING

Data processing in relation to the web services of this site take place at the head office of the company and are conducted solely by the technical personnel of the office responsible for such processing.

TYPES OF DATA HANDLED

Data provided voluntarily by the user, as described fully above.

The optional, voluntary and explicit sending of electronic mail by Users to the addresses indicated above may result in the subsequent acquisition by BeOnMe of the sender’s e-mail address and of any other personal information included in the message that is needed in order to respond to requests and to send commercial information and any newsletters to the User.

USE BY MINORS

The User declares to be an adult as defined by applicable law. Minors may only use this site with the help of a parent or guardian.
